Terms of Service

These terms of service govern access to the Profil-e platform and its related services. By creating an account or using our tools, you acknowledge that you have read, understood and accepted all of these terms. Profil-e is a brand operated from Quebec, Canada, and subject to Quebec law.
1. Acceptance of terms
By accessing the Profil-e platform, you unreservedly accept the entirety of these terms. If you do not accept any of these clauses, you must immediately cease using the service. For certified coaches, acceptance occurs upon account activation; for invited clients, upon creation of the emotional profile at the invitation of their coach.
2. Service description
Profil-e is a SaaS psychometric tool intended for certified coaches, organizational development consultants and professional firms. It enables the generation of individual emotional profiles (18 questions, 15 minutes), 5-element relational analyses and team emotional signatures. Psychometric calculation is delegated to the bewell-engine, the scientific source of truth of the Be Well Together suite.
3. User accounts
You are responsible for the confidentiality of your credentials. Any access performed with your credentials is deemed to be yours. Certified coach and administrator accounts may be subject to multi-factor authentication (MFA), which must then be enabled and maintained. You agree to notify Profil-e without delay in the event of suspected unauthorized access at info@profil-e.ca.
4. Acceptable use
The following are strictly prohibited: automated scraping of content or reports; resale or redistribution of psychometric results to a third party without the explicit consent of the assessed person; use of the tools for hiring selection purposes without compliance with applicable regulatory frameworks; and any use contrary to the professional ethics of coaching. Profil-e reserves the right to suspend any account in case of abusive use.
5. Intellectual property
The platform, its code, its calculation methods, its questionnaires and the Profil-e brand remain the exclusive property of their respective holders. Certified coaches retain ownership of the reports they produce for their clients. Outputs generated by bewell-engine are licensed under a non-transferable clinical use license, exclusively within the scope of the certified coach's practice.
6. Pricing and billing
Access to features is billed according to the published price list (certification, profiles, renewals). Profiles are consumed individually or via a balance of prepaid credits. No refund is granted for a profile already generated. Certification fees are refundable within 14 days of registration, unless the training has already been partially consumed. Any price change is announced 30 days in advance.
7. Confidentiality and data
The processing of personal information is governed by our Privacy Policy as well as our Law 25 / GDPR page. Profil-e applies the principle of data minimization and a strict clinical firewall: raw responses and individual scores are accessible only to the responsible certified coach and, where applicable, to an authorized clinical psychologist. No individual data is shared with the employer in the absence of sufficient aggregation.
8. Certified coach responsibilities
The certified coach undertakes to comply with the code of ethics of their profession, to obtain informed consent from each assessed person, to use the results with a view to development and not judgment, and never to use a Profil-e profile as the sole decisional criterion for hiring, termination or promotion. Interpretation of the results remains a professional act under the sole responsibility of the coach.
9. Termination
You may terminate your account at any time by writing to info@profil-e.ca. Profil-e may suspend or terminate an account in the event of breach of these terms, non-payment exceeding 30 days, or use that compromises the integrity of the platform. Termination results in the deletion of the account; however, profiles generated and reports already delivered remain retained in accordance with the retention policy.
10. Limitation of liability
Profil-e provides a tool to assist with emotional and relational understanding. It does not constitute a medical act, a clinical diagnosis or psychological advice. Profil-e's liability is limited, to the extent permitted by applicable law, to the amount of sums paid during the last 12 months. Profil-e declines any liability for the consequences of decisions made by a coach or an employer on the basis of the results produced.
11. Governing law and jurisdiction
These terms are governed by the laws in force in the province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal, subject to remedies available to consumers under the Consumer Protection Act.
12. Changes to terms
Profil-e may update these terms to reflect the evolution of the service or the regulatory framework. Any substantial modification is notified by email to account holders with a minimum notice of 30 days. Continued use of the service after the effective date constitutes acceptance of the revised terms.
